Senate Judiciary Committee: John McCain is a “natural born” American
The Senate Judiciary Committee on Thursday passed a resolution expressing the “sense of the Senate” that Sen. John McCain is constitutionally eligible to run for president of the United States.

“The Senate should adopt this resolution and put to rest any question of Sen. McCain’s status as a ‘natural born citizen,’” said Sen. Patrick Leahy, a Vermont Democrat and chairman of the committee. “There is no doubt in my mind that he is eligible to run for president.”
The resolution says: “Whereas John Sidney McCain III was born to American citizens on an American military base in the Panama Canal Zone in 1936: Now, therefore, be it resolved that John Sidney McCain III is a ‘natural-born citizen’ under Article II, Section 1 of the Constitution of the United States.”
The two Democratic candidates for president — Sens. Barack Obama and Hillary Clinton — support the resolution.

McCain was a citizen of Panama until he was sixteen years old, at which time he was naturalized a US citizen by statute. Therefore, McCain is not a natural born American citizen as required by the Constitution for the united States of America, and he cannot be President.

Such a silly Senate resolution does not amend the Constitution for the united States of America; McCain is not natural born citizen of America and cannot serve as President, US Senator’s resolution notwithstanding.

According to the Naturalization Law of 1790 that sought to define the term: “And the children of citizens of the United States that may be born beyond sea, or outside the limits of the United States, shall be considered as natural born citizens.” Article II of the Constitution (FindLaw Internet Legal Resources)
Some might define the term “natural-born citizen” as one who was born on United States soil. But the First Congress, on March 26, 1790, approved an act that declared, “The children of citizens of the United States that may be born beyond sea, or outside the limits of the United States, shall be considered as natural-born citizens of the United States.” That would seem to include McCain, whose parents were both citizens and whose father was a Navy officer stationed at the U.S. naval base in Panama at the time of John’s birth in 1936.

The Senate Judiciary Committee cannot change the Constitution. To do this they have to adhere to Article V of the Constitution.
McCain has claims that The Naturalization Act of 1790 (26 March 1790) covers his status as a “natural born” citizen. That is entirely not true. A close look at that Act indicates that it only covered “admission as a citizen”—meaning naturalization—and in any case, that Act was repealed in part on 29 January 1795, and the rest was repealed on 14 April 1802. So that argument does not work, because it was repealed long before McCain was born, and because it created naturalization instead of natural born citizenship were it still in effect.
It is illegal what the Senate Committee did. You need to change the Constitution by 2/3 vote as stated in Article V..
